Booking Terms & Conditions

1. Definitions
For these Terms & Conditions:
“Sammy Sessions” means the person or legal entity identified as the supplier on the relevant Sammy Sessions invoice, quote or Booking Confirmation.
“Client” means the individual, business, organisation or other legal entity named as the client on the Booking Confirmation. If an individual makes a booking on behalf of an organisation, that individual confirms that they have authority to make the booking on that organisation’s behalf.
“Booking” means the agreement between Sammy Sessions and the Client for the Services described in the Booking Confirmation.
“Booking Confirmation” means the written quote, invoice, email, booking form or other written confirmation specifying the Event Date, Venue, Services, performance or appearance times, Total Fee and any specifically agreed requirements.
“Event” means the event, function, appearance, performance or engagement for which Sammy Sessions has been booked.
“Event Date” means the date and scheduled commencement time stated in the Booking Confirmation.
“Venue” means the location stated in the Booking Confirmation.
“Services” means only the DJ performance and/or Public Appearance specifically identified in the Booking Confirmation.
“Total Fee” means the total price stated in the Booking Confirmation.
“Booking Payment” means the 50% upfront payment required to reserve the Event Date.
“Written Approval” means approval given by Sammy Sessions in writing, including by email, SMS or another electronic message that can subsequently be produced as evidence. Verbal conversations do not constitute Written Approval for changes to a Booking.
“Attendee” means any guest, customer, employee, contractor, performer, venue staff member or other person attending or involved with the Event.
“Equipment” means any DJ, audio, computer, lighting, cabling, controller, mixer, speaker, microphone, stand, case or associated equipment owned, hired or supplied by Sammy Sessions.
“Music or Set Request” means any request concerning songs, artists, genres, playlists, set lists, set order, musical style, tempo, must-play songs, do-not-play songs, dedications or any other direction concerning the musical content of the DJ performance.
“Significant Change” has the meaning set out in section 13.
“14-Day Cut-Off” means the point exactly 14 calendar days before the scheduled commencement time of the Event.
2. Acceptance of These Terms
These Terms & Conditions form part of every Booking with Sammy Sessions.
The Client must be provided with or given access to these Terms before making the Booking Payment.
Payment of the Booking Payment constitutes confirmation that the Client:
- has received these Terms;
- has had a reasonable opportunity to read them;
- understands that they form part of the Booking; and
- agrees to be bound by them.
Where the Booking Confirmation and these Terms conflict, the Booking Confirmation takes priority only where it expressly states that a particular term is being changed.
No verbal statement changes these Terms unless subsequently confirmed by Written Approval.
3. Booking Payment and Final Payment
A 50% Booking Payment is required to reserve the Event Date.
The Event Date is not secured until the Booking Payment has cleared.
Once the Booking is confirmed, Sammy Sessions may:
- decline other bookings for the Event Date;
- reserve the agreed time;
- prepare music or performance material;
- organise Equipment;
- make travel or logistical arrangements; and
- perform administrative and preparation work relating to the Booking.
The remaining balance is payable by the payment date specified in the Booking Confirmation.
Cancellation and the 50% Booking Payment
The commercial intention of the Booking Payment is to secure the Event Date and compensate Sammy Sessions for reasonable losses and costs associated with reserving and preparing for the Booking.
If the Client cancels, Sammy Sessions may retain from amounts already paid the amount legally recoverable for reasonable losses and costs arising from that cancellation, including reasonable preparation expenses and lost booking opportunities, after taking reasonable steps to reduce avoidable loss.
Where applicable law requires any part of an advance payment to be refunded, Sammy Sessions will comply with that law.
Nothing in these Terms makes an amount non-refundable where Australian law requires that amount to be refunded.
4. Services – Strictly DJ or Public Appearance
A Sammy Sessions Booking is strictly limited to the Services identified in the Booking Confirmation.
Services may consist of:
- a DJ performance;
- a Public Appearance; or
- both, where expressly stated.
Unless specifically included in the Booking Confirmation, the Booking does not include:
- MC or hosting duties;
- event management;
- support work or personal assistance;
- photography or videography;
- promotional work;
- additional performances;
- speeches or presentations;
- interviews;
- meet-and-greet services;
- additional appearances;
- moving venue equipment;
- providing general event staff; or
- any other service not expressly agreed in writing.
The Client cannot require additional duties on the Event Date simply because Sammy Sessions is already present at the Venue.
Additional Services require Written Approval and may incur an additional fee.
5. Public Appearance Bookings
A Public Appearance includes only the activities specifically agreed in the Booking Confirmation.
Where applicable, the Booking Confirmation should specify whether the appearance includes activities such as:
- photographs;
- meet-and-greet interaction;
- speaking;
- presenting;
- interviews;
- media appearances;
- promotional activity; or
- stage appearances.
Attendance at an Event does not constitute automatic consent to participate in activities not agreed beforehand.
6. Personal Boundaries and Consent
For the purpose of this section, “Consent” means clear, voluntary and express permission given by Sammy at the relevant time for the specific physical contact proposed.
Consent must not be assumed because of:
- a previous interaction;
- a previous photograph;
- previous physical contact;
- familiarity or friendship;
- a joke or comment;
- silence;
- a failure to immediately object; or
- consent given on another occasion.
Picking Up or Lifting Sammy
No Client, Attendee, venue staff member or other person may pick up, lift, carry, grab or otherwise physically handle Sammy without Sammy's express Consent at that specific time.
This includes attempting to:
- lift Sammy from the ground;
- pick Sammy up for a photograph;
- carry Sammy;
- pull Sammy onto another person;
- physically reposition Sammy;
- grab Sammy around the body; or
- encourage another person to do any of the above.
An attempted unauthorised lift or physical handling is treated as a Critical Safety Breach, whether or not Sammy is actually lifted and whether or not physical injury occurs.
7. Prohibited Behaviour
Sammy Sessions has a zero-tolerance policy for behaviour that threatens safety, dignity or personal boundaries.
Prohibited Behaviour includes:
- physical assault;
- attempted physical assault;
- unauthorised picking up, lifting, grabbing or carrying;
- unwanted physical contact;
- threats of violence;
- intimidation;
- harassment;
- sexual harassment;
- discriminatory abuse;
- deliberately humiliating or degrading conduct;
- throwing objects at or toward Sammy Sessions;
- spitting;
- deliberately obstructing Sammy Sessions from leaving an area;
- deliberately interfering with Equipment;
- entering or remaining within the DJ performance area after being directed to leave;
- deliberately damaging property or Equipment;
- aggressive behaviour;
- intoxicated behaviour that creates a safety risk; or
- any other conduct that a reasonable person would consider to create an immediate risk to personal safety.
Critical Safety Breach
A Critical Safety Breach includes:
- assault or attempted assault;
- unauthorised lifting, picking up, grabbing or carrying;
- credible threats of violence;
- deliberate Equipment damage;
- serious harassment;
- sexual harassment; or
- conduct creating an immediate safety risk.
Following a Critical Safety Breach, Sammy Sessions may immediately stop performing, disconnect Equipment where safe to do so and leave the Event without providing a warning first.
For less serious conduct, Sammy Sessions may give a direction or warning where it is safe and reasonable to do so.
If unsafe behaviour continues after that warning, Sammy Sessions may terminate the performance or appearance and leave.
The Client must take reasonable steps to ensure venue staff and Attendees comply with these requirements.
Termination for prohibited conduct does not remove any right Sammy Sessions may have to recover payment or damages lawfully arising from the Client's breach.
8. Equipment – Strict No-Touch Policy
Only Sammy Sessions or a person specifically authorised by Sammy Sessions may operate, move, disconnect or adjust Equipment.
Clients and Attendees must not:
- touch DJ controls;
- touch laptops or controllers;
- adjust mixer controls;
- touch speakers or audio equipment;
- disconnect cables;
- connect personal devices without permission;
- move Equipment;
- place drinks on Equipment;
- place food on Equipment;
- place liquids immediately beside Equipment;
- lean on Equipment;
- enter the DJ working area after being asked not to; or
- otherwise interfere with Equipment.
The Client must take reasonable steps to ensure Attendees understand and comply with this requirement.
9. Equipment Damage and Repair Costs
Where Equipment is damaged as a result of an act or omission for which the Client is legally responsible, the Client must reimburse Sammy Sessions for the reasonable cost of diagnosing and rectifying that damage.
This may include:
- diagnostic or assessment fees;
- technician labour;
- replacement parts;
- repair costs;
- freight or transport required for repair;
- reasonable temporary Equipment hire required while damaged Equipment is unavailable; and
- replacement where the Equipment cannot reasonably or economically be repaired.
Audio Technician Assessment
Repair costs will be based on a written quote, invoice or assessment from a qualified audio technician, electronics technician, manufacturer-authorised repairer or professional repair business that regularly repairs the type of Equipment concerned.
A copy of the relevant quote, assessment or invoice will be provided to the Client on request.
If a qualified technician determines that Equipment:
- cannot be repaired;
- cannot safely be returned to professional use; or
- would cost more to reasonably repair than to replace,
the Equipment will be treated as beyond economical repair.
In that situation, the reasonable replacement cost of equivalent professional Equipment may be claimed.
Where the exact model is discontinued, an equivalent current model with substantially comparable professional functionality may be used to determine reasonable replacement cost.
Sammy Sessions will not use Equipment damage as an opportunity to obtain an unreasonable financial benefit or an unrelated Equipment upgrade.
10. Music and Set Requests
Requests Must Be Organised Before the Event
All Music or Set Requests must be submitted to Sammy Sessions and receive Written Approval no later than the 14-Day Cut-Off.
A request being sent does not mean it has been accepted.
A Music or Set Request becomes part of the Booking only when Sammy Sessions provides Written Approval.
No Requests During the Performance
Music or Set Requests are not accepted during the Event unless Sammy Sessions has specifically agreed otherwise in writing before the Event.
Clients and Attendees must not repeatedly:
- approach the DJ booth requesting songs;
- hand phones to Sammy showing song requests;
- demand changes of genre;
- request changes to the agreed set;
- pressure Sammy Sessions to play particular music; or
- interfere with the performance for the purpose of making requests.
Attendees cannot override the musical direction agreed between Sammy Sessions and the Client.
Sammy Sessions retains professional and creative control over mixing, track order, transitions and the overall flow of the DJ performance, subject to the Music or Set Requests agreed before the Event.
Sammy Sessions may make reasonable changes where required for safety, legal compliance, venue requirements, technical reasons or the effective delivery of the performance.
11. Venue and Client Responsibilities
The Client must provide accurate information concerning the Event and Venue before confirmation.
The Client is responsible for ensuring that Sammy Sessions has:
- lawful permission to perform at the Venue;
- reasonable access for Equipment loading and unloading;
- a safe performance location;
- appropriate access to electrical power where required;
- suitable protection from rain, water, excessive heat or other weather where the Event is outdoors;
- sufficient setup and pack-down access;
- details of applicable sound restrictions;
- details of venue access restrictions;
- details of stairs, restricted loading areas or other relevant access issues; and
- any venue rules that materially affect the Services.
The Client is responsible for obtaining venue permissions, licences or approvals that are the responsibility of the event organiser.
Sammy Sessions is not responsible for a failure to perform caused solely by the Client or Venue failing to satisfy a requirement disclosed or reasonably required for safe performance.
12. Performance Times and Client-Caused Delays
The agreed performance or appearance start and finish times are those shown in the Booking Confirmation.
Unless otherwise stated, setup and pack-down time are separate from the contracted performance duration.
If the Client, Venue or Event causes the performance to begin late, the originally agreed finishing time continues to apply.
Examples include delays caused by:
- the Venue not being ready;
- guests arriving late;
- speeches running over time;
- another performer running late;
- Event scheduling changes; or
- delayed access to the performance area.
The full agreed Total Fee remains payable where Sammy Sessions was ready and available to perform but performance time was reduced because of Client, Venue or Event delays.
An extension beyond the original finish time is not automatic.
Additional performance time requires:
- Sammy Sessions' agreement;
- venue approval where required; and
- agreement regarding any additional fee.
13. Significant Changes to a Booking
A Significant Change means a requested change that alters or materially affects the Services that Sammy Sessions agreed to provide.
A Significant Change includes:
- changing the Event Date;
- changing the Venue;
- changing the suburb or geographical location;
- materially changing the start time;
- materially changing the finish time;
- increasing the performance duration;
- changing a DJ Booking into a Public Appearance or vice versa;
- adding MC duties;
- adding speaking or presenting duties;
- adding promotional responsibilities;
- changing agreed Music or Set Requests;
- adding must-play or do-not-play requirements;
- changing the agreed style or genre of the performance;
- materially changing Equipment requirements;
- changing an indoor Event to an outdoor Event or vice versa;
- introducing circumstances requiring materially different travel, setup or staffing;
- materially changing access conditions;
- changing the fundamental nature or format of the Event; or
- requesting any other change that reasonably requires substantial additional preparation, Equipment, travel, time or safety arrangements.
14-Day Rule
Significant Changes requested after the 14-Day Cut-Off will be declined.
The original Booking remains in effect.
If the Client decides not to proceed because Sammy Sessions declines a Significant Change requested after the 14-Day Cut-Off, that decision will be treated as a cancellation by the Client and the cancellation provisions of these Terms apply.
A request made before the 14-Day Cut-Off is not automatically approved. Sammy Sessions must still provide Written Approval.
Minor administrative corrections that do not alter the Services, price, workload, safety, timing, Venue or performance requirements are not Significant Changes.
14. Unsafe Conditions
Sammy Sessions is not required to commence or continue performing where a reasonable person in the same circumstances would consider conditions unsafe.
Unsafe conditions may include:
- violence or threats;
- dangerous electrical conditions;
- exposed Equipment to rain or water;
- unstable staging;
- dangerous crowd behaviour;
- blocked safe access or exit;
- serious harassment;
- dangerous intoxication;
- unauthorised physical handling; or
- any immediate risk of injury or serious Equipment damage.
Where reasonably possible, Sammy Sessions may allow the Client or Venue an opportunity to rectify a non-immediate safety issue.
Sammy Sessions is not required to remain in a situation involving an immediate threat to personal safety.
15. Photography, Recording and Use of Sammy Sessions' Image
The Client does not acquire ownership of Sammy Sessions' name, image, logo, branding or other intellectual property merely by making a Booking.
Any commercial advertising, endorsement or promotional campaign using Sammy Sessions' name, image or branding must be separately approved in writing.
Ordinary Event photography and personal photographs are not prohibited unless otherwise advised.
Photography or recording must not involve:
- unauthorised physical handling;
- interference with the DJ performance;
- interference with Equipment; or
- conduct otherwise prohibited by these Terms.
Any specific photography, filming or privacy restrictions applying to the Event should be disclosed before the 14-Day Cut-Off.
16. Circumstances Outside Either Party's Reasonable Control
Neither party is responsible for a failure or delay caused solely by circumstances genuinely outside that party's reasonable control where that party could not reasonably have prevented the circumstance.
Examples may include:
- severe weather making the Event unsafe;
- natural disaster;
- government restrictions;
- emergency venue closure;
- serious transport disruption;
- widespread power failure;
- sudden serious illness or medical emergency; or
- another comparable event beyond reasonable control.
The affected party must notify the other party as soon as reasonably practicable.
Where the Event cannot proceed, the parties will first consider whether the Booking can reasonably be rescheduled.
Any refund, credit, cancellation cost or other financial consequence remains subject to applicable Australian law and any reasonable unrecoverable costs already incurred.
17. Liability for Third Parties and Venue Failures
To the extent permitted by law, Sammy Sessions is not responsible for loss caused by:
- acts of the Client;
- acts of Attendees;
- Venue failures;
- unsafe Venue conditions not created by Sammy Sessions;
- third-party Equipment;
- venue sound restrictions;
- power failure not caused by Sammy Sessions;
- Event scheduling decisions made by others; or
- circumstances outside Sammy Sessions' reasonable control.
This clause does not exclude liability to the extent that loss was caused by Sammy Sessions' own breach, negligence or other conduct for which liability cannot lawfully be excluded.
18. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or other protection under the Australian Consumer Law or any other law where that right or protection cannot legally be excluded, restricted or modified.
Where these Terms and a mandatory legal requirement conflict, the mandatory legal requirement prevails.
19. Changes to These Terms
The Terms applying to a Booking are the Terms provided to the Client when that Booking is accepted.
Sammy Sessions will not retrospectively change those Terms for a confirmed Booking without the Client's agreement.
Changes to an individual Booking require Written Approval.
20. Entire Agreement
The Booking Confirmation and these Terms constitute the written agreement between Sammy Sessions and the Client regarding the Booking.
They replace previous discussions concerning the matters covered by the final Booking, subject to any rights that cannot lawfully be excluded.
The Client should ensure that any promise or requirement that is important to the Booking appears in the Booking Confirmation.
21. Failure to Enforce a Term
If Sammy Sessions chooses not to enforce a term on one occasion, this does not permanently waive that term or prevent Sammy Sessions from enforcing it on another occasion.
22. Severability
If a court or tribunal determines that any particular provision of these Terms is unlawful, void or unenforceable, that provision is to be removed or limited only to the minimum extent required by law.
The remaining provisions continue to operate to the extent permitted by law.
23. Disputes
If either party believes the other has breached the Booking, that party should provide written notice describing:
- what occurred;
- the term believed to have been breached; and
- the outcome being requested.
The parties should make a reasonable good-faith attempt to resolve the dispute directly before commencing formal proceedings where appropriate.
Nothing in this section prevents either party from:
- obtaining urgent legal relief;
- contacting police regarding safety or criminal conduct;
- making an insurance claim; or
- exercising a statutory right or remedy.
24. Governing Law
The Booking is governed by the laws applicable in Victoria, Australia, subject to any law requiring otherwise.
25. Final Acceptance
By paying the Booking Payment, the Client confirms that:
- the Booking details are accurate;
- they have read these Terms & Conditions;
- they understand the Booking is strictly for the agreed DJ and/or Public Appearance Services;
- they understand the personal-boundary requirements;
- they understand that Sammy must not be picked up, lifted or physically handled without express Consent;
- they understand the Equipment no-touch policy;
- they understand Music and Set Requests must be agreed before the 14-Day Cut-Off;
- they understand requests will not be accepted during the performance unless pre-approved;
- they understand Significant Changes after the 14-Day Cut-Off will be declined; and
- they agree to these Terms & Conditions.
Sammy Sessions reserves the right to stop or terminate Services where these Terms permit it, particularly where personal safety, personal boundaries or Equipment safety are placed at risk.
